Sefinvite OÜ registration number 17423779, Harju maakond, Tallinn, Kesklinna linnaosa, Narva mnt 5, 10117, contact@1office.co (hereinafter, Selfinvite) has created the application called "Selfinvite" (hereinafter, Application) available in the main stores (Google Play / App Store) and of which it owns exclusive. These conditions of use govern the relations relating to the services offered by Sefinvite in favor of Selfinviter whether they are Guest, Special Guest, or Host, as below definition, and must be considered together with the Privacy Policy and the cookie policy.

Selfinvite provides a set of services, including an online space available to Users (hereinafter the Platform), as defined below, which through them can present and search for Private Events, as defined below, and confirm their participation through the Application. By using the service, users accept the terms of use of Selfinvite. The Service provided by Selfinvite and the use of the Application or the Platform, as defined below, are subject to the terms of use and any other regulation or policy published by Selfinvite on the Platform. In case of disagreement with any term or condition or subsequent modifications thereof, or in case of dissatisfaction with the Services offered by Selfinvite, the User will have the right and duty to immediately terminate the use of Selfinvite. Selfinvite has the right, but not the obligation, to strictly comply with the conditions of use through the moderation of the community and litigation in the appropriate judicial offices.

Definitions

Terms of Use or TU: the provisions of this document.

Contents:

• files containing texts, images, audio and / or video recordings, data and / or information organized in a database and in any case all files, documents and / or information in any format made by Users and that Selfinvite makes available through the Application, Platform or Services, including any Content licensed by a third party;
• files containing texts, images, audio and / or video recordings, data and / or information organized in the database and in any case all files, documents and / or information in any format are transmitted, copied, sent, made available to the Users trough the Application also by the Users themselves.

Contribution:

the amount shown by Selfinvite to the Guests reflects what is requested by the Host to the Guests participating in the Event as reimbursement of the expenses incurred by the first for the organization, management and conduct of the Event (hereinafter Expense Account) including the amount due to Selfinvite for the use of the Application (up to €25, 20%; from €26 to €100; 15%; from €101 upwards, 10%, more than the Expense Account, hereinafter, the Attendance Fee). The exact amount of the Contribution exposed to the Guest may vary in consideration, for example, of the currency in which it is expressed.

Personal Data:

all personal information relating to each User, including name, address and telephone number, possibly collected through the Application.

Event:

occasional gathering of private individuals or groups, shared economy made known through the Platform and the Selfinvite Application for the purpose of social eating.

Host:

the User who is conductor or owner, in any capacity, of a location for private events or suitable for hosting private events and who organizes one or more Events and presents them on the Application, after registering with the Application and accepting the relative specific conditions contractual. For each Event, the Host may request as reimbursement up to a maximum of € 200,00 per person.

Guest:

the User who participates in an Event by contributing to the expenses, up to a maximum of two people per account (Guest + Special Guest)

Platform:

the domain https://selfinvite.eu; including any subdomains, any URLs or portions thereof.

Application:

for mobile devices, developed by Selfinvite and available on the Apple and Android digital stores, with the name Selfinvite.

Service:

Services that Selfinvite offers through the Application, which can also be consulted through the Platform.

User:

all physical or legal persons who access the Application.

Application Description:

The User registered on the Application can search for Host Events and send a request to participate in one or more of them. The Host benefits from an online space on which he/she can register his/her Event format and present it, explaining any ancillary services provided therein as well as the financial contributions required for participation and aimed at reimbursement, even on a flat-rate basis, of the expenses incurred for the organization. management and conduct of the Event (Expense Account). Selfinvite reserves the right to approve the Event presented by the Hosts. It is understood that Selfinvite has no control over the conduct of Users and excludes any liability in this sense within the maximum limits permitted by law.

Any Guest will pay the Attendance Fee (composed of expense accounts plus cost of management made explicit by Selfinvite) to take part in the Event.

The Services include an open online, landing "showcase" Platform, accessible by anyone without registration, through the domain https://selfinvite.eu; including any subdomains, any URLs or portions thereof. The Platform also allows non-Users to view and obtain information regarding the Application and related TUs, as well as one or more Events; through the Platform, Hosts can present their own Events.

Privacy:

The User declares to have read the Selfinvite Privacy Policy, available at https://selfinvite.eu/privacy/; including any subdomains, any URL or portions thereof, as well as on the appropriate section of the Application, as amended from time to time; this information governs the acquisition and use by Selfinvite of the Users' personal data.

In particular, Selfinvite acknowledges and confirms that any processing of personal data that derives from the execution of the TU will be carried out solely for the purposes connected to such execution or for other purposes for which the User has given express and unequivocal consent, and in any case in compliance with the provisions of the law.

User Account:

To register and use the service, each User must first create a User Account throughout one of the social login providers available from the Application, providing personal data concerning him/her, essential for the proper functioning of the communication service. Users, by creating a User Account, certify that they are at least 18 years old at the time of their registration and that they have a telephone line associated with a mobile device.

When filling in the forms provided in the section reserved for the User, this will indicate a User Id (of which the system will automatically verify the uniqueness). In the event that the User-Id is already present in the database, the User must indicate a different one until the system positively verifies its uniqueness.

Reservation:

Information relating to the Event, provided by the Hosts, is made available on the Platform, in which the characteristics and any additional services made available are described in detail: date, times, type of event, maximum number of participants that can be hosted, Contributions and any other relevant information (hereinafter, the Description Form). In no case the Host is allowed to reserve the right to integrate and / or change the characteristics, details and description of the proposals outside the cases provided for in these TU. The User who intends to book one or more seats at the Event of a Host, makes the request for participation on the Application (hereinafter, the Request for Participation) up to one hour before the start of the event. The Guest will have time to complete the payment until the event begins.

Refunds:

Without prejudice to Selfinvite's extraneousness in order to the relationships established between Guest and Host, if the Guest cannot, for any reason, take part in the Event, he/she will have the right to request a refund of the amount already paid to the Host through the Application, after deducting the part under the responsibility of Selfinvite (up to €25, 20%; from €26 to €100, 15%; from €101 upwards, 10% for the management of the reimbursement) under the following condition:

• the Request is sent no later than one hour before the start of the Event (in this case, Cancellation by the Guest).

In the event of a canceled Event (in this case Cancellation by the Host): the Host may cancel the Event up to two hours before the start of the Event itself, and no charge will be made to either Host or Guest.

Payments:

Selfinvite makes a third-party service available to Guests and Hosts, through which the Guest who intends to participate in an Event can pay the Contribution. Selfinvite, therefore, does not act or operate in any case as an official seller or payment service provider, limiting itself to providing access to the Platform and its maintenance.

In case of Guest + Special Guest, the Guest needs to cover the Contribution for both of them, equivalent to two times the Contribution.

The payment through the Application will constitute a Contribution for the participation in the Event and cannot be claimed in any way by the Guest, except Cancellation by the Guest or Cancellation by the Host.

Payouts:

After the Event is finished (the duration specified in the Event Description) the Host will receive the total Contribution (Payout Amount) from the number of Guests which attended the Event after 12 hours. If, for any reason, the Event is substantially not compliant with what described in the Event Description, the Guest can submit a request for Refund (Refund Request) within this 12 hours window time, directly to the Host.

If the Host accepts the Refund Request (Refund Accepted), the Refund (Contribution) will be returned to the Guest deducting the part under the responsibility of Selfinvite (up to €25, 20%; from €26 to €100, 15%; from €101 upwards, 10% for the management of the reimbursement).

If the Host denies the Refund Request (Refund Denied), the Contribution will be payout to the Host.

If the Host neither Accepts nor Denies within 12 hours from the End of the Event (Refund Unanswered) the Contribution will be payout to the Host as regular Payout.

Rating:

Hosts and Guests have ratings mechanisms provided by Selfinvite Application composed by Feedbacks (to Guest) and/or Reviews (to Host). These ratings constitute the way to demonstrate User liability and reliability over the Selfinvite Application.

Feedbacks:

the Host can leave within 30 days of the End of the Event, a Feedback to each Guest which attended his/her event. The Feedback includes a rating 1 to 5 with a comment and optionally some pictures.

Reviews:

the Guest can leave within 30 days of the End of the Event, a Review to the Event Host selecting a rating 1 to 5 over 4 categories including a comment and optionally some pictures.

Taxes, Licenses and Certifications:

Selfinvite does not pay taxes on behalf of Users or Guests or Hosts. Users, Guests and Hosts, are solely responsible for any Taxes relating to them and deriving from any Contract entered into.

Depending on the circumstances, including the number of transactions conducted and the subject of the transaction, the law may require licenses or certifications. Selfinvite is not responsible for determining the cases in which it is necessary to be in possession of a license and / or a certificate for the use of the Services or the Application and the Platform, for the organization, management and conduct of Events or for the carrying out a transaction through the Application or the Platform.

Responsibility of Selfinvite:

Disclaimer of Warranties: The User accepts that the use of the Application, the Platform and the Services offered by them is entirely at their own risk and responsibility. The Application and the Service are provided "as is" and "as available", without guarantees and / or liability of any kind. All express and implied warranties, including, without limitation, the warranties of merchantability and fitness for a particular purpose are expressly excluded to the maximum extent permitted by law, and to the same extent, Selfinvite disclaims all warranties for safety, reliability, timeliness, accuracy and performance of the Application or Platform.

Limitation of Liability: In no event shall Selfinvite be held liable for damage to third parties or contracting parties resulting, directly or indirectly, from the use of the Application or Service, or resulting from any contract between the User and third parties. This disclaimer covers, among others, direct, indirect, incidental, special, exemplary and consequential damages, including: loss of profits, loss of data or loss of goodwill; computer damage; cost of replacement products or services; any damage related to personal or physical injury.

User safety and feedback:

Selfinvite cares about the reliability of its Users and the successful outcome of the Events as well as the transactions entered into through the Application and makes every effort to achieve the best possible degree of transparency.

Likewise, Selfinvite is not required to verify, either prior or subsequent, comments, reviews or feedbacks, issued by Users in relation to an Event or a Host, or, if a User deems that the Feedback may be offensive to himself or to the community, he/she is asked to immediately notify Selfinvite by writing to info@selfinvite.eu. Selfinvite will verify the offensiveness of the Feedback/Review reported, considering the opportunity for any measures that may include, depending on the case and at the sole discretion of Selfinvite, the suspension and / or cancellation of the account reported.

Content posted on the Application and/or the Platform:

Contents from Users: All Content published, transmitted through, or accessible via links from the Application or the Platform, are the sole responsibility of the User from whom such Content originates. The User is solely responsible for any published Content, email or material otherwise made available through the Application. The User is aware that Selfinvite does not control and is not responsible for the Content made available through the Application, and that by using the Application, the User may be exposed to offensive, indecent, inaccurate, illegal, misleading content.

Links to other websites: The Platform, and the Services may contain links to third party websites or resources. Selfinvite is not responsible for:

• the availability or accuracy of such websites or resources;
• the content, products, or services on or available from such websites or resources.

Modifications:

Selfinvite reserves the right, at its sole discretion, to modify the Application, the Platform or the Services, or to modify these Terms of Use, at any time and without prior notification. In case of changes to these Conditions, they will be published on the Platform or notice will be given when the Application is updated. The "Last update date" at the bottom of these Conditions will also be updated. By continuing to access or use the Platform or Services from the publication of a modification of the Platform or from the sending of the notification of a variation, the User accepts these Conditions as modified. If such changes are deemed unacceptable, the only possibility will be to cease using the Platform.

Intellectual and industrial property rights:

Without prejudice to the provisions contained in the Selfinvite Privacy Policy, any Content transmitted through the Application or through the Platform by Users, either by e-mail or by other means, for any reason, will be treated as non-confidential and non-exclusive property. In the event that users hold all the rights to such communications or Contents, they explicitly grant Selfinvite and its designated licensees a non-exclusive license, with the perpetual right, and worldwide, to copy, distribute, display, execute , publish, translate, adapt, modify, and or use such material for any purpose, regardless of the form or medium (now known or currently unknown) in which it is used.

Indemnify:

The User of the Application undertakes to release, defend, indemnify and hold Selfinvite and its affiliates and subsidiaries, and their officers, directors, employees and agents harmless from and against any claim, liability, damage, loss and expense, including, without limitation, reasonable legal and accounting fees, arising from, or in any way related to:

• access or use of the Application, Platform, Services or Contents by them or the violation of these Terms of Use by the Users themselves;
• the Contents processed, transmitted, copied, sent, made available by the Users themselves;
• Any of the following actions carried out by the User himself:
  • interaction with any User;
  • the request for a Service.

Relationship between the parties:

Selfinvite and the Users, both Guest and Host, are independent parties, each of which acts in its name and for its own purposes. The present TU they do not create any bond of subordination, agency, representation, association, intermediation, partnership, employment or franchising relationship between Selfinvite and any User.

None of the clauses contained in the TU, or in the Selfinvite policies, or any other material can be considered intended to constitute, create, give effect or otherwise recognize a company, an agency, a joint venture or a formal business entity of any type, or to create a relationship of trust between the Parties.

Applicable law and competent court:

These Terms of Use are governed by and construed in accordance with the laws of the Republic of Estonia.

Additional conditions:

Selfinvite is not responsible for the relationships created between Users.

The headings of the clauses of the Terms of Use have a descriptive function and do not affect their interpretation.

The User accepts that the rights and obligations contained in these Terms of Use, as well as any other documents that are incorporated therein by reference, may be freely and legitimately transferred by Selfinvite to third parties in the event of a merger or acquisition, or of another event.

In any case, through the Platform, Users undertake to comply with all national and international laws and all regulations currently in force for the use of Selfinvite Services in relation to the activities carried out on the application and on the Platform by the Users themselves. No derogation from these Conditions of Use will be granted, without the written authorization obtained and a new contract signed between Selfinvite and the User.

All communications to the attention of Users will be sent through the Application and in some cases the User will receive the confirmation / request to the e-mail address provided when registering on the Application, as well as a text message to enable the payments. Messages and notifications are considered received 24 hours after sending the notification or email.

Account Deletion:

Users can decide at any time to delete their account using the "Delete user" button directly from their profile. All sensitive data will be anonymized and the process is irreversible. Selfinvite reserves the right to keep such data anonymously for statistical purposes only.
